Goals of Estate Planning

The goal of estate planning is to transfer property upon death in the most efficient and timely manner and with the least amount of expense. A sound estate plan must consider and balance several factors such as how the client's assets are titled, who are the intended beneficiaries, and the tax ramifications of the transfer of the estate assets.

How We Can Help

The attorney's role is to outline options for the client that meet the client's personal objectives and to suggest alternative solutions and techniques to achieve those objectives. At times, a “simple” will is all that may be appropriate when considering the client’s current life situation. In many situations, however, the use of a revocable living trust or testamentary trust may be the better vehicle for assuring that the clients goals and objectives are accomplished.

Other Considerations

Estate planning considerations also include planning for “non-probate” assets such as jointly owned property, POD (payable on death) and TOD (transfer on death) accounts, life insurance, employee benefit plans and retirement accounts, annuities, and ownership interests in closely held businesses. Finally, comprehensive estate planning will also include planning for the inevitable “end of life” considerations through the use of advance directives, living wills, healthcare powers of attorney, and general durable powers of attorney.
